📄 1. Acceptance of Terms

By downloading, installing, or using the WrapChat application or website, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines (collectively, the "Agreement"). If you do not agree to any part of this Agreement, please do not use WrapChat.

These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000 ("IT Act"), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), and the Digital Personal Data Protection Act, 2023 ("DPDP Act").

WrapChat operates as a significant social media intermediary as defined under IT Rules 2021 and complies with all applicable obligations thereunder.

👤 2. Eligibility & Account Registration

2.1 Age Requirement

You must be at least 18 years of age to use WrapChat. By using our platform, you represent and warrant that you are 18 years or older. WrapChat actively monitors for underage use and will immediately terminate, suspend, or require verification of any account where we reasonably believe the user may be under 18.

2.2 Account Creation

You may create an account by registering with your mobile number (OTP verification). By registering, you authorise us to collect, store, and process the information you provide in accordance with our Privacy Policy. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and complete
• Not share your account with any other person
• Notify us immediately at wrapchat9@gmail.com of any unauthorised use of your account

2.3 One Account Per Person

You may maintain only one active WrapChat account. Creating multiple accounts to evade a ban, suspension, or these Terms is strictly prohibited and will result in permanent termination of all associated accounts.

2.4 Account Deletion

You may delete your account at any time through the Settings page in the app. Upon deletion, your profile and messages will be scheduled for removal per our data retention policy. Note that uninstalling the app does not delete your account — you must follow the in-app deletion steps.

💬 3. Types of Content

3.1 Your Content

Any content you upload, post, share, or transmit on WrapChat — including text messages, photos, videos, audio, files, profile pictures, and status updates ("Your Content") — remains your responsibility. By posting Your Content, you grant WrapChat a non-exclusive, royalty-free, worldwide, sublicensable licence to use, store, display, and distribute Your Content solely for the purpose of operating and improving the platform.

You represent and warrant that Your Content does not violate any applicable Indian law or third-party rights, and that you have all necessary rights and permissions to share it on WrapChat.

3.2 Prohibited Content

You must not upload, share, or transmit content that:

• Is unlawful under any applicable Indian law, including the IT Act, Indian Penal Code, or POCSO Act
• Is harmful, threatening, abusive, harassing, defamatory, obscene, or invasive of another's privacy
• Contains child sexual abuse material (CSAM) — any such content will be immediately reported to law enforcement including the National Commission for Protection of Child Rights (NCPCR) and the Cyber Crime Portal (cybercrime.gov.in)
• Promotes or incites violence, terrorism, or communal hatred
• Infringes any intellectual property right of any person
• Contains malware, spyware, viruses, or any other malicious code
• Constitutes spam, unsolicited commercial communications, or chain messages
• Impersonates any person or entity, or misrepresents your identity or affiliation
• Contains nudity, pornography, or sexually explicit material
• Violates the dignity of women (including content prohibited under the Indecent Representation of Women (Prohibition) Act, 1986)
• Spreads misinformation or deliberately false information

3.3 WrapChat's Content

All content owned or operated by WrapChat — including but not limited to the app interface, design, logos, trademarks, software, databases, and platform features — is the exclusive property of WrapChat and is protected by applicable Indian intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from WrapChat's content without our express written consent.

🚫 4. Prohibited Conduct

In using WrapChat, you agree that you will NOT:

• Stalk, harass, threaten, or intimidate any other user on or off the platform
• Use WrapChat for any fraudulent, deceptive, or manipulative purpose
• Solicit money, financial information, or gifts from other users
• Use another person's identity or create fake profiles
• Engage in catfishing or misrepresent your appearance, age, location, or identity
• Use automated tools, bots, scripts, or crawlers to scrape user data
• Attempt to gain unauthorised access to WrapChat's systems, servers, or other users' accounts
• Conduct commercial activities, solicitation, or advertising on WrapChat without our prior written consent
• Distribute another user's personal information without their consent ("doxxing")
• Share intimate images of another person without their consent (a criminal offence under Section 66E of the IT Act and Section 354C of the IPC)
• Engage in any conduct that violates the IT Act 2000, IT Rules 2021, DPDP Act 2023, or any other applicable Indian law
• File false or malicious reports against other users

💫 5. Connect & Dating Features

5.1 Connect Feature

WrapChat's "Connect" feature allows users to discover and send connection requests to other nearby users who have opted in to be discoverable. You may only use this feature for genuine personal connection purposes. Misusing Connect to harass, spam, or deceive other users will result in immediate account suspension.

5.2 Mutual Consent

Chat is only unlocked between two users after mutual acceptance of a connection request. No user can initiate a chat without the other user's explicit acceptance. This is a core safety feature of WrapChat.

5.3 Real-World Safety

WrapChat strongly advises all users to exercise caution when meeting in person with someone they have connected with on the platform. You are solely responsible for your offline interactions. WrapChat recommends:

• Meeting for the first time in a public place
• Informing a trusted friend or family member of your plans
• Not sharing sensitive financial information with matches
• Trusting your instincts — if something feels wrong, leave and report the user

5.4 No Background Checks

WrapChat does not conduct criminal background checks on its users. While we verify phone numbers at registration, we make no guarantee as to the identity, character, or conduct of any user. You engage with other users at your own risk. If you encounter any user who you believe poses a safety risk, please report them immediately using the in-app reporting tool.

5.5 Ephemeral & Disappearing Messages

WrapChat offers optional disappearing messages and ephemeral chat modes. You agree not to take screenshots or record ephemeral content without the sender's consent. Recording or distributing another person's disappearing messages without consent may constitute a violation of their privacy rights under Indian law.

WrapChat is committed to protecting your personal data. Our full Privacy Policy explains how we collect, use, store, and share your data and is available at wrapchat.in/privacy.

By using WrapChat, you acknowledge and agree that we process your data in accordance with:

• The Digital Personal Data Protection Act, 2023 (DPDP Act)
• The Information Technology Act, 2000 and associated rules
• The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011

Your data is stored on servers located in India. We do not transfer your personal data outside India without appropriate safeguards as required under applicable law.

You have the right to access, correct, and request deletion of your personal data by contacting us at wrapchat9@gmail.com.

💳 7. Payments & Subscriptions

7.1 In-App Purchases

WrapChat may offer premium features, subscriptions, or virtual items for purchase ("Premium Services"). All purchases are subject to the pricing displayed at the time of purchase. Payments may be processed through the Google Play Store, Apple App Store, or our integrated payment gateway partners compliant with Reserve Bank of India (RBI) regulations.

7.2 Auto-Renewal

Subscription plans automatically renew at the end of each billing period unless cancelled before the renewal date. You will be notified of any price changes before they take effect. Continued use after a price change constitutes acceptance of the new price.

7.3 Cancellation

You may cancel your subscription at any time through your app store account settings (Google Play or Apple App Store) or through WrapChat's in-app settings. Cancellation takes effect at the end of the current billing period. Deleting your WrapChat account does not automatically cancel your subscription — you must cancel separately.

7.4 Refunds

As per our refund policy:

• Refund requests for subscriptions purchased through the Google Play Store or Apple App Store must be submitted directly to Google or Apple respectively
• For direct purchases through WrapChat, refund requests may be submitted within 7 days of purchase by contacting wrapchat9@gmail.com
• Refunds will not be issued for partially used subscription periods, virtual items already consumed, or accounts terminated due to violations of these Terms
• All refunds, where approved, will be processed in accordance with applicable RBI guidelines and may take 7–10 business days

7.5 Taxes

All prices are inclusive of applicable Goods and Services Tax (GST) unless otherwise stated. You are responsible for any other applicable taxes in your jurisdiction.

©️ 8. Intellectual Property

The WrapChat name, logo, app design, software, user interface, and all associated intellectual property are owned by or licensed to WrapChat and are protected under the Trade Marks Act, 1999 and the Copyright Act, 1957 of India.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use WrapChat solely for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, reproduce, or distribute WrapChat's software, design, or content
• Reverse engineer, decompile, or disassemble the WrapChat app
• Use WrapChat's trademarks, logos, or brand assets without written permission
• Create derivative works based on WrapChat's platform or content

🛡️ 9. Safety & Reporting

9.1 Reporting Mechanisms

WrapChat provides in-app tools to Block & Report any user or content that violates these Terms or makes you feel unsafe. Reports are reviewed by our Trust & Safety team. We take all reports seriously and aim to respond within 24 hours for urgent safety matters and 72 hours for general reports.

9.2 Grievance Officer

In accordance with IT Rules 2021, WrapChat has appointed a Grievance Officer for India. Users may submit complaints or concerns to:

9.3 Law Enforcement Cooperation

WrapChat fully cooperates with Indian law enforcement agencies and will disclose user information when required by a valid court order, summons, or lawful government request under the IT Act 2000 or any other applicable Indian law. WrapChat will preserve user data as required by law.

9.4 CSAM Reporting

Any content involving the sexual exploitation of minors will be immediately removed and reported to the National Crime Records Bureau (NCRB), NCPCR, and cybercrime.gov.in. WrapChat has zero tolerance for child sexual abuse material.

9.5 Content Moderation

WrapChat uses a combination of automated systems and human moderators to review content that is reported or flagged. We publish a monthly transparency report on content moderation actions as required under IT Rules 2021 for significant social media intermediaries.

⚠️ 10. Disclaimers

THE WRAPCHAT APP, WEBSITE, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE INDIAN LAW.

WrapChat does not warrant that:

• The platform will be uninterrupted, error-free, or free from viruses
• Any particular match or connection will lead to a successful relationship
• User profiles are accurate or that users are who they claim to be
• The platform will meet your specific requirements

You are solely responsible for your interactions with other users. WrapChat is not responsible for the conduct of any user on or off the platform.

⚖️ 11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, WrapChat and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.

WrapChat's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the amount you paid to WrapChat in the 3 months preceding the event giving rise to the claim, or ₹500 (five hundred rupees), whichever is greater.

Nothing in these Terms limits WrapChat's liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable Indian law, including consumer protection laws.

🏛️ 12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Telangana, India, subject to the dispute resolution process below.

12.2 Informal Resolution

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at wrapchat9@gmail.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

12.3 Arbitration

If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Hyderabad, Telangana. The language of arbitration shall be English. The arbitral award shall be final and binding on the parties.

12.4 Consumer Disputes

Nothing in these Terms affects your rights as a consumer under the Consumer Protection Act, 2019. You may also file complaints with the National Consumer Disputes Redressal Commission (NCDRC) or the relevant State Consumer Forum.

🚪 13. Termination

13.1 Termination by You

You may terminate your account at any time through the Settings menu in the app. Upon termination, these Terms (except for provisions that survive termination by their nature) will cease to apply to you.

13.2 Termination by WrapChat

WrapChat may suspend or terminate your account immediately and without notice if:

• You violate any provision of these Terms or our Community Guidelines
• We believe you are engaged in fraudulent, illegal, or harmful activity
• We receive a valid order from a competent court or government authority
• Your use of WrapChat poses a risk to the safety or security of other users
• You are found to be under 18 years of age

13.3 Appeals

If you believe your account was terminated or your content was removed in error, you may appeal within 30 days by emailing wrapchat9@gmail.com with a detailed explanation. We will review your appeal and respond within 15 business days.

13.4 Effect of Termination

Upon termination of your account, your right to use WrapChat ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) shall survive.

📝 14. Amendments to These Terms

WrapChat reserves the right to modify these Terms at any time. We will provide notice of material changes through the app, by email, or by updating the "Effective Date" at the top of this page.

Your continued use of WrapChat after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using WrapChat and delete your account.

We recommend reviewing these Terms periodically to stay informed of any updates.
